A change of mind by Norman Delanty in May-June 2001 from a course of action he had decided upon which if he had gone ahead would not have led to the medical negligence charge he will now be facing from the Petitioner
It needed a second appeal to the Ombudsman under Freedom Of Information to get Beaumont Hospital to release the file And all documents were not released by Beaumont Hospital in the file they released Those documents were in chronological number order for the time period and had Norman Delanty refused to release a document the numbering would be out of sequential order so the was no non release of documents for the time period in question 2001-2002
As in Spring 2002 Norman Delanty had admitted to a fellow consultant he was as he called it partial responsibility for what had happened And the petitioner on receiving that confirmation in writing from the petitioner’s surgeon and Norman Delanty’s fellow consultant wrote to Norman Delanty asking him to abide by his original decision and a copy was sent to the petitioner’s GP at the time who has subsequently released back that letter to the petitioner That particular letter was not on the main Beaumont File. Both the surgeon’s letter and the letter sent to Norman Delanty in spring 2002 are available as proof of how the events happened So on a process of elimination Norman Delanty has to have a correspondence file with that letter on it and one has to ask what other correspondence?
A search done on Mitchell 62 Butterfield avenue 1950-1086 and on it in the 1960’s were Patrick Mitchell and a Carmel Mitchell well that was the person he married however she was in America It would appear to be Isabella Smyth taking the name of his first wife like that until 1970 and then you had a Peter I Mitchell added matching the Peter I Smyth found born 1950 He now lives in Dalkey as Peter PA Smyth Then you had added Edmond G Mitchell born 1952 He now lives on Wellington Road and is a consultant in Beaumont Hospital practices and qualified as Edmond B Smyth He is registered as a doctor as Edmond Smyth However has rooms in Blackrock Clinic as E Bruce Mitchell Who in 2007 said he was Margaret Mitchell’s son and by inference Barry White’s cousin Neither any relation to Barry White as they are the sons of Isabella Smyth who died December 2013 And Pat Mitchell was an in law Now the only way they could be related is if Peter C Kennedy born 2nd quarter of 1946 was Pat Mitchell’s and then these persons would be half brothers now that would be an interesting scenario
Now Edmond B Smyth has to be aware of the Data Protection Act as when Nemesisone was having one of three MRI scans after surgery 2003 a Dr Smyth came into the scanner room, as the radiographer called him and the radiographer said “I will drop that file into you later” what file was Dr Smyth looking for? As under Data Protection Act he had not got the right to Nemesisone’s file Nemesisone did not think it unusual at the time as Barry White up to that point 2003 or publicly since that Nemesisone is aware ever admitted Edmond Smyth was related to him, And the Data Protection Commissioner has reprimanded hospitals for allowing doctors see files for people of which they not the doctor And those three scans totally refute what Ciaran Foley said November 2016 and the judge hearing the case replicated in a cut and paste job done from the transcript
According to a former employee of Barnardos’ Tracing Agency what Barry White had decided on in April 2001 was a common thread in Ireland to inform a person at the funeral or the wake they were not the deceased’s child. As was the initial placing of a distant cousin in a relations family to replace a child who had died in that family
Norman Delanty’s change of decision was in May June 2001 Barry White also had a change of mind in April – May 2001 on a decision he had made in April 2001 after his mother’s death and he then backtracked on it And the one common denominator in both of those change of decisions was Rosemary White nee Mc Donnell who as already said was very anxious in May 2001 to find out the name of Norman Delanty Irrespective of what her motive was as the petitioner could see at the funeral mass that Nerys Ryan given her grand public entrance to the mass was no different to Rosemary White nee Mc Donnell she just played a different game.
Why did Barry White agree well first of all the will of his mother was unsigned and the letter was attached to the will second of all the letter would have contained reference to the events of 1997-1998 when approached his mother to make a settlement on Nerys Georgina Ryan out of the trust and she refused on the basis she would have to lie and say that Nerys Georgina Ryan was the petitioner’s it was then she spoke to Aideen Monson who then made the vague reference to the petitioner about events 10 years earlier And last of all it gave Barry White access to a large sum of money and if he was to fulfill his wife’s aspiration to become a judge he would need supplementary income from somewhere How is the petitioner aware of Rosemary White’s aspirations well at a meeting in March 2003 Barry White made the comment that been a judge was like semi retirement and Rosemary White made the comment “Barry you will like it that is why I encouraged you to apply” Barry White also made the comment to the petitioner “our parents are the only ones we have you have to forgive them” The petitioner did not challenge that comment at the time However at a meeting in September 2004 the petitioner asked Barry White what he meant by the comment and he lied and denied saying it The petitioner did comment to Rosemary White in Summer 2002 after he was appointed a judge how was Barry White going to fund his children’s education as a judge As they were still very young and Rosemary had aspirations for them all to attend the top fee paying schools in Dublin Rosemary White said she had an insurance policy out The petitioner is not aware of insurance firms paying for a drop in income whatever about a loss of income So what is covering those expensive fees?
Why Norman Delanty reacted to Rosemary White’s bully tactics in May 2001 if that is what happened only Norman Delanty can answer that one However a letter was added to the Beaumont file where one of Norman Delanty’s registrars stated categorically they had met the petitioner in February 2003 and the petitioner was neither out in Beaumont hospital nor did they met the said registrar And the petitioner’s proof of that is the same signed time sheets which are available for inspection can be substantiated by bank account payments for the salary to match the hours worked and confirmed by the Recruitment consultants who placed the petitioner in the company concerned So Norman Delanty reacted to something to take such imprudent action
