An Alternative Biographical Sketch

August 1, 2014

A Retirement profile appeared on Barry White in The Irish Independent 8th July 2014 page 11 well it gave a very glowing synopsis Without making any references to the mistakes he made while presiding over cases which led to him been off the bench for over a year 2008-2009 and subsequently doing Grievously Bodily Harm cases until one last murder case Autumn 2013

The slip-ups well documented in the Newspaper reports at the time and were as follows The Rachel Reilly murder case July 2007 where it was said he appeared to be helping out the defence lawyer in his case, who is a brother of the current Chief Justice Well given that he was a defence lawyer before a judge “old habits die hard” In the next case the murder of Siobhan Kearney in his summing up in January 2008 he was calling the murder victim Rachel rather than her correct name Siobhan, it was after that case that he was off the bench for one year In November 2010 he commented on the victim impact statements and had to give apologies immediately after the lunch recess

Now his work as a defence lawyer was glossed over in The Irish Independent so here are some of the persons he defended and the work he did

Malcolm Mc Arthur in the Nulle Prosecute case now it was the prosecution who submitted a Nulle Prosecute plea however the defence team had to be aware it was been submitted, only they know at what point they were told of the prosecution decision the other barrister in the case was the former Minister for Justice Michael Mc Dowell. – See Newspaper court reports for the time period

Barry White defended The Border Fox Dominic Mc Glinchy who before been caught had given Gardaí the run around over the Irish Border counties hence his name -See Newspaper court reports for the time period

Oscar Breathnach – See Newspaper court reports for the time period – Oscar Breathnach in gratitude for the defence Barry White gave him at his trial would send him a Christmas card every year for a long while after that

Larry Dunne a drug baron and prior to that a cash in transit van robber – See Newspaper court reports for the time period – Larry Dunne would pay Barry White in cash for his defence and that of his brothers and other members of his gang Now this was the late 1970’s and early 1980’s and his sister Derval White met one of the members of the gang through a colleague of hers at the time and when that was repeated back to Barry White at his next defence consultation he did not take it too well saying he defended this people he did not socialise with them

Martin Cahill see his book for his defence team and Mannix Flynn see his book for his defence team

John Gilligan now Nemesisone does not know whether Barry White played any role in his defence however on Mr Gilligan’s conviction in 2001 a Senior Counsel from the area Barry White lives in and matching his size and description and he was the only one at that time in that neighbourhood was in the company of one other barrister from a totally different area and a Solicitor who died in 2003 and when they were leaving the pub A taxi driver was given €100 to drive the inebriated solicitor home by the barrister from the area Barry White lives and the same description It seems according to the taxi driver who drove him the solicitor was so inebriated he said a lot through the drive home and the other barrister from the totally different area along the route of the inebriated solicitor could not keep him quiet The fare would ordinarily have cost about a quarter of the €100 for the distance and the time period

In the 1980’s Barry White and his solicitor Jim Orange were sanctioned for a case they were in by the judge presiding over the case for the way they handled it after they came back from lunch – See Newspaper court reports for the time period

In the mid 1980’s and for almost all of the 1990’s Barry White was on a retainer by Readymix and then Roadstone for court cases regarding the overloading of their lorries The retainer had started when Barry White met the then chairman of Readymix at a social function and said the type of work he did and he would mostly get his clients off on technicalities. Once engaged Barry White would get the Readymix lorries off on technicalities and after that he was hired by Roadstone to do the same work. Readymix (Eire) Ltd. is now called CEMEX Ireland, it was founded in Dublin in 1965, and was quoted as Readymix plc on the Irish Stock Exchange in 1972

In regard his comments on rape cases in the article on him 8th July 2014 Irish Independent Barry White as a defence lawyer appeared to find the persons from The Rape Crisis Centre daunting who would attend those cases to assist the victim usually Barry White said by more than one person and he had a description name he would put on them
